Carey Dorgan v. Norman Weis
Gary Wiseman recently received a defense verdict from a St. Louis City jury in this motor vehicle rear-ender case for Auto-Owners Insurance. Case involved a significant impact late at night on I-44 west of St. Louis. The main issue was whether the insured kept a careful lookout. Both vehicles were severely damaged in the impact and then caught fire after the occupants had been evacuated.
Plaintiff argued that this was a simple rear-end accident where she had seen a danger in the road and reacted to avoid an accident, but the insured negligently did not. We argued that the circumstances of the accident showed the insured did not have sufficient time or distance to react and avoid the accident. Plaintiff claimed back injuries that required extensive physical therapy but no surgery. She asked the jury for a verdict of $60,000 - $75,000. The jury deliberated approximately one hour and forty-five minutes before returning the defendant’s verdict.
